International Crimes Tribunal Chief Prosecutor Md Aminul Islam said Bangladesh does not know under what status ousted prime minister Sheikh Hasina is staying in India. Speaking to journalists on the morning of August 17, 2026, he said she could be brought back through a legal fight. He said Hasina has been convicted through a judicial process and that the Bangladesh government has already submitted an extradition request to India.

Aminul Islam said necessary steps had been taken through legal procedures to return Hasina to Bangladesh. Addressing a report by an Indian media outlet suggesting court permission might be needed regarding Hasina, he cautioned against drawing conclusions from it. He said the report did not specify whether she had political asylum in India or what exact status she held there.

On August 5, 2024, a Bangladesh Air Force aircraft carrying Hasina landed at Hindon air base in Ghaziabad, near Delhi. Indian National Security Adviser Ajit Doval welcomed Hasina and her sister Sheikh Rehana that evening. The following day, Indian External Affairs Minister S Jaishankar told Parliament that Hasina had requested permission to come to India temporarily and entered after approval. India has remained silent on her specific immigration status.
