HC Publishes Full Verdict Voiding Key Sections of 15th Amendment Abolishing Caretaker System

The High Court has released its full verdict declaring Sections 20 and 21 of the 15th Amendment, which abolished the caretaker government system, unconstitutional and void. The court also invalidated several added constitutional articles and reinstated the referendum provision under Article 142, saying its removal undermined the Constitution’s basic structure. The 15th Amendment made 54 changes in total, but the court left the decision on other provisions to the next Parliament. The verdict followed writs filed by civil society leaders in 2023.

Full Verdict Published on Annulment of Provision Abolishing Caretaker Government System

The full verdict of the High Court has been published, declaring Sections 20 and 21 of the 15th Amendment to the Constitution—which abolished the much-discussed caretaker government system—as contradictory to the Constitution and therefore void. The 139-page verdict was published on the Supreme Court’s website on Tuesday.
