High Court Questions Constitutionality of MPO-Teacher Transfer Policy for Private Schools and Colleges

The High Court has issued a rule seeking clarification on why the MPO-included teacher transfer policies of 2021 and 2024 for private schools, colleges, and madrasas should not be declared unconstitutional. The court also questioned why teachers appointed before December 30, 2015, by managing committees or governing bodies are not given equal transfer opportunities under existing or future policies. The petition, filed by 50 private school teachers, argues the transfer rules cause discrimination, violating Articles 27 and 29 of the Constitution.

Why the transfer of MPO-included teachers is not unconstitutional: High Court

The High Court has issued a rule seeking to know why the provisions of Rule 12.2 of the Manpower Structure and MPO-included Teacher Transfer Policy-2021 for private educational institutions (schools and colleges), and the MPO-included Teacher Transfer Policy-2024—applying through automatic software for NTRCA-recommended MPO teachers working in private schools, colleges, and madrasas—should not be declared unconstitutional.
