Bangladesh’s High Court has dismissed a writ petition challenging the validity of Article 70 of the Constitution and seeking suspension of the announced presidential election schedule. A bench comprising Justice Khizir Ahmed Chowdhury and Justice A F M Saiful Karim issued the order on Tuesday.
Attorney General Md Ruhul Quddus Kajal represented the state, while Advocate Yunus Ali Akand argued for the petitioner. Akand filed the petition last Thursday. The petition questioned Article 70 and the validity of the election schedule announced on August 6 for the presidential election.
It sought a rule asking why Article 70 should not be declared inconsistent with the Constitution and why the Election Commission’s schedule should not be declared beyond legal authority. Akand said the provision prevents lawmakers from voting independently. The High Court’s dismissal means there is no legal obstacle to the presidential election process under the current schedule.
